Terms of Service

Welcome to Pomora. These Terms of Service ("Terms") govern your access to and use of the Pomora website, applications, and services (collectively, the "Service") operated by Pomora ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Pomora. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account and credits

New accounts receive a one-time grant of 20 free credits. Additional credits can be obtained through subscription plans or one-time credit packs. Credits are non-transferable between accounts and cannot be redeemed for cash. Credits purchased in a one-time pack do not expire. Subscription credits are granted monthly and do not roll over between billing periods unless explicitly stated in your plan.

3. Payment

Payments are processed by Paddle, our Merchant of Record. By purchasing a subscription or credit pack you agree to Paddle's Checkout Buyer Terms. All prices are shown in USD unless otherwise noted. Applicable taxes are added at checkout.

4. Subscription billing

Paid plans are billed in advance on a recurring monthly basis. Your subscription renews automatically at the end of each billing period until canceled. You may cancel at any time from your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.

5. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy. We reserve the right to suspend or terminate accounts that violate this policy.

6. Ownership of generated content

Subject to your compliance with these Terms, you own the images you generate through the Service and may use them for personal and commercial purposes. You are responsible for ensuring your prompts and resulting outputs do not infringe any third-party rights, including copyright, trademark, or publicity rights.

7. Service availability

The Service depends on third-party providers including fal.ai for image generation and Anthropic for prompt processing. We do not guarantee uninterrupted availability. If the Service is unavailable for an extended period, we will take reasonable steps to restore it but are not liable for consequential losses.

8. Limitation of liability

To the maximum extent permitted by law, Pomora shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our aggregate liability to you shall not exceed the total amount you paid us in the twelve months preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Unused credits are non-refundable upon voluntary account closure.

10. Changes

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Pomora operates, without regard to its conflict of law provisions.
